What is the P1 Visa?

The P1 visa is a non-immigrant visa category that allows internationally recognized athletes, members of athletic teams, and entertainment artists (including music groups) to enter the United States temporarily to participate in competitions, specific events, or performances. This visa is intended for individuals or teams who have achieved a high level of recognition in their field at an international level.

Who can apply?

The P1 visa can be applied for by:

  • Individual or Team Athletes: Athletes competing at an internationally recognized level, including both individuals and team members. The candidate must demonstrate that their participation is essential to the success of the event or competition in the U.S.

  • Artists and Entertainment Groups: Entertainment groups or performing arts groups that are recognized internationally. At least 75% of the group members must have a substantial and long-standing history of working together, usually for at least one year.

What are the criteria for eligibility for the P1 Visa?

To qualify for the P1 visa, the applicant must meet the following criteria:

  • International Recognition: The athlete or group must demonstrate significant recognition at the international level in their field. This can be done through awards, rankings, media coverage, or evidence of participation in high-level events.

  • Participation Contract: The candidate must have a contract or invitation letter from a U.S. organization sponsoring the event, competition, or series of events in which the candidate will participate.

  • Evidence of Competition or Performance: The applicant must provide evidence that the competition or performance in the U.S. requires the participation of athletes or artists of internationally recognized high caliber.

How does the application process work?

The process for obtaining a P1 visa involves the following steps:

  • Sponsor Petition: The U.S. organization must file Form I-129, Petition for a Non-Immigrant Worker, with USCIS on behalf of the athlete or group.

  • Supporting Documentation: The petition must include documents that prove the international recognition of the applicant and the nature of the competition or event.

  • Consular Interview: After the petition is approved, the applicant must attend an interview at the U.S. consulate in their home country to obtain the visa.

Benefits of the P1 Visa

The P1 visa allows top-level athletes and artists to participate in competitions and events in the U.S., providing a platform to showcase their skills on an international stage. It also allows spouses and children under 21 years of age of the P1 visa holder to accompany the applicant with the P4 visa. Although P4 visa holders cannot work, they can study in the U.S.

This visa offers a unique opportunity for internationally recognized athletes and artists to contribute their talent in the United States, participating in prestigious events and promoting cultural exchange.
