FAQ - Frequently Asked Questions

What is the EB2/EB3 Visa with Sponsor?

The EB2 and EB3 visas are immigrant visa categories that allow foreign workers to obtain permanent residency in the United States with the sponsorship of an employer. The EB2 is intended for professionals with advanced degrees or exceptional abilities in their fields, while the EB3 is for skilled workers, professionals with a bachelor's degree, or other workers performing tasks that require less qualification.

Who can apply?

The EB2 with sponsor is for individuals with an advanced degree (such as a master’s or doctorate) or who possess exceptional abilities in areas such as science, arts, or business. The EB3 is for skilled workers with at least two years of experience, professionals with a bachelor's degree, or workers occupying positions that require less qualification. In both cases, the applicant must have a job offer from a U.S. employer willing to sponsor their application for a green card.

What are the eligibility criteria for the EB2/EB3 with Sponsor?

For the EB2 with sponsor, the applicant must have an advanced degree or exceptional abilities. The employer must prove that there are no qualified American workers for the position, a process known as labor certification. For the EB3, the applicant must have at least a bachelor's degree (for the professionals subcategory) or two years of work experience (for skilled workers). In the case of other workers, the position must be a non-seasonal job that requires less than two years of training or experience.

How does employer sponsorship work?

The U.S. employer must initiate the process by obtaining labor certification from the U.S. Department of Labor, proving that there are no available and qualified U.S. citizens to fill the offered position. After approval, the employer submits an immigration petition (Form I-140) on behalf of the foreign worker. This sponsorship is essential for the approval of the EB2 or EB3 visa and demonstrates that the employer is committed to hiring the applicant for the position.

Benefits

The EB2/EB3 visa with sponsor provides a solid route to obtaining permanent residency in the United States, allowing the worker and their family (spouse and children under 21 years old) to live and work in the U.S. These visas offer security and stability, with the opportunity to advance their career in an American company. Additionally, family members can also obtain work authorization and enjoy the same residency benefits as the primary visa holder.
