What is the L1 Visa?

The L1 visa is a non-immigrant visa category that allows multinational companies to transfer employees from their foreign branches, subsidiaries, or affiliates to an office in the United States. There are two main subcategories of the L1 visa: L1A, for managers and executives, and L1B, for employees with specialized knowledge. This visa is particularly useful for companies wishing to expand their operations in the U.S. or bring key talent into the country.


Who can apply?

The L1 visa is intended for employees of multinational companies who meet the following criteria:

  • Eligible Employer: The employer must be a company with operations both in the U.S. and abroad, with a qualifying relationship between the entities, such as a branch, subsidiary, parent, or affiliate.

  • Eligible Employee: The employee must have worked for the company outside the U.S. for at least one year in the three years preceding the visa application. For the L1A visa, the employee must have served in a managerial or executive capacity, while for the L1B visa, the employee must have specialized knowledge about the company’s products, services, research, management systems, or other essential areas.


What are the eligibility criteria for the L1 Visa?

To qualify for the L1 visa, both the employer and employee must meet the following requirements:

  • Relationship Between Entities: The U.S. company and the foreign company must have a qualifying relationship, such as a branch, subsidiary, parent, or affiliate.

  • Employee’s Position: The employee must be transferred to a managerial, executive position (L1A), or to a position requiring specialized knowledge (L1B).

  • Duration of Transfer: The L1A visa is initially granted for up to 3 years (with the possibility of extension up to a maximum of 7 years), while the L1B visa is granted for up to 3 years (with the possibility of extension up to a maximum of 5 years).


How does the application process work?

The application process for the L1 visa involves the following steps:

  • Employer Petition: The U.S. company must file Form I-129, Petition for a Non-Immigrant Worker, with USCIS to initiate the process.

  • Documentation: The petition must be accompanied by documents proving the relationship between the companies, the employee’s role, and the need for the transfer.

  • Consular Interview: After the petition is approved, the employee must undergo an interview at the U.S. consulate in their home country to obtain the visa.
